The medical cannabis program in Puerto Rico is governed and enforced by the Puerto Rico Department of Health (Departamento de Salud) through the Junta Reglamentadora del Cannabis Medicinal. Formally legalized under Act 42-2017, the framework restricts commercial activities strictly to medical applications. Traditional smoking or combustion of cannabis products is legally prohibited in public spaces; the market instead services registered patients via vaporization, tinctures, edibles, capsules, and topicals.
License Categories & Fee Structures
Puerto Rico separates commercial operational licenses into distinct tiers. Permitting and annual licensing fees are directly tied to the total active operational square footage of the facility:
1. Cultivation Tiers
- Up to 10,000 sq ft: $10,000 licensing fee
- 10,000 to 20,000 sq ft: $15,000 licensing fee
- 20,001 to 30,000 sq ft: $25,000 licensing fee
2. Manufacturing & Processing Tiers
- Up to 5,000 sq ft: $10,000 licensing fee
- 5,001 to 25,000 sq ft: $20,000 licensing fee
- 25,001+ sq ft: $30,000 licensing fee

All licensed operators must adhere to strict seed-to-sale tracking workflows to log and verify every stage of the cannabis lifecycle on a daily basis. The mandated regulatory system tracks the complete chain of custody across all verticals:
- Cultivation Tracking: Individual plants must be tagged and logged across developmental shifts, recording nutritional logs, location transfers, and batch-level harvests.
- Processing Documentation: Manufacturing hubs must document all oil extractions, formulation runs, and byproduct conversions to minimize unrecognized waste and account for precise material weights.
- Dispensary Point-of-Sale: Retail dispensaries are required to trace point-of-sale customer transactions back to the origin plant batch, automatically validating real-time patient card limits and tracking strict daily purchase allotments.
